1. Acceptance of Terms

By accessing or using the Fade & Find application and website (fadeandfind.com), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service.

2. Description of Service

Fade & Find is a location-based discovery application that aggregates information about estate sales, antique stores, auctions, flea markets, thrift stores, and boutiques. The Service provides mapping, route planning, filtering, and organizational tools to help users plan treasure-hunting outings.

3. Free and Premium Tiers

Fade & Find offers two service tiers:

Free Tier includes: map access, basic filters, favorites, and basic route planning.

Premium Tier ($4.99/month or $39.99/year) includes: route optimization, group sharing, alerts, tag search, been-there archive, and 24-hour early access to new listings.

Pricing is subject to change with 30 days notice to active subscribers.

4. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate and complete information when creating your account. Fade & Find reserves the right to terminate accounts that violate these terms.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Scrape, crawl, or data-mine the Service without written permission
• Resell or redistribute Service content without authorization
• Upload malicious code or attempt to interfere with Service operations
• Harass, abuse, or harm other users

6. Data Accuracy

Fade & Find aggregates listing data from third-party sources. We do not guarantee the accuracy, completeness, or timeliness of any listing information, including business hours, addresses, or operational status. Users are encouraged to verify information before visiting any location. User-submitted reports such as marking a business as closed or flagging for verification are community contributions and are not independently verified by Fade & Find.

7. Intellectual Property

The Fade & Find name, logo, and application design are the intellectual property of Fade & Find. Third-party listing data remains the property of its respective owners. You may not reproduce, distribute, or create derivative works from Fade & Find content without express written permission.

8. Payments and Subscriptions

Premium subscriptions are billed monthly or annually in advance. All payments are processed through secure third-party payment processors. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Refunds are not provided for partial subscription periods.

9. Limitation of Liability

Fade & Find is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Fade & Find shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, including but not limited to travel to incorrect locations, reliance on inaccurate listing data, or loss of data.

10. Termination

Fade & Find reserves the right to suspend or terminate your access to the Service at any time for violation of these terms. You may cancel your account at any time through the app settings.

11. Changes to Terms

We may update these Terms of Service from time to time. Continued use of the Service after changes constitutes acceptance of the updated terms. Material changes will be communicated via email to registered users.

12. Governing Law

These Terms shall be governed by the laws of the State of Nebraska, United States, without regard to conflict of law principles.
